Welcome to Opus Major Privacy Policy! This policy describes how and why Opus Major collects and processes information (the "Data"), including personal data, when you play our mobile games (the "Games"), and when you visit our opusmajor.io website (the "Website"), together the "Services". It also informs you about your rights, which are designed to protect your privacy.

Opus Major is the data controller of the Data described in this policy, within the meaning of the EU General Data Protection Regulation (GDPR) and the French data protection law.

If you have concerns about the information you make available to us or about our use of it under this privacy policy, we advise you not to use our Services.

Opus Major is a French video games studio: OPUS MAJOR SAS, registered in Paris (RCS Paris 922 671 268), 15 rue des Halles, 75001 Paris, France.

2.1 Why we collect your Data

Depending on the Game, you can play without giving us any Data, your progress being saved on your device only, or you may need to create an account. The privacy section of each Game's page on the App Store and Google Play shows which Data that Game collects.

We only use your Data when we have a legal basis for doing so. Here is why we may use your Data, the legal basis we rely on in each case, and the Data concerned (described in section 2.2):

• To provide the Game, save your progress and diagnose and fix malfunctions: Performance of our contract with you (player ID, gameplay data, device and technical data, IP address).
• To understand how the Game is played and improve it (game balance, difficulty, tutorial, performance): Consent (player ID, gameplay data, device and technical data, IP address).
• To measure where our players come from (mobile attribution): Consent (player ID, device identifiers used for attribution, install information, IP address).
• To answer your messages and analyse your feedback: Legitimate interest, namely answering you and improving the Game (player ID, your messages and feedback, our answers).
• To manage your consent and answer your requests to exercise your rights: Compliance with our legal obligations (player ID, consent choices, your requests and our answers).
• To answer requests from public authorities: Compliance with our legal obligations (any Data required by the request).
• To keep evidence to defend our rights: Legitimate interest, namely the defence of our interests (consent choices, terms of service accepted, and any Data required).

When you first launch a Game, we ask for your consent to collect analytics. Only if you accept, we use your Data, on the basis of your consent, to:

• understand how the Game is played and improve it (game balance, difficulty, tutorial, performance);
• measure where our players come from (mobile attribution), i.e. which store page, website or campaign led to the installation of the Game.

You can withdraw your consent at any time in the Game's Settings. From then on, no new Data is collected: the Game stops sending Data, and our analytics and attribution partners stop collecting it. Withdrawing your consent does not affect the lawfulness of the processing carried out before.

2.2 Data we collect

Depending on the Game and on your choices, we collect:

• a random player ID generated by the Game on your device. It is not linked to your name, email or any account;
• gameplay data: sessions (start, end, duration), tutorial progress, in-game progression, in-game items and currency;
• device and technical data: device model, operating system and version, language, Game version, performance (frame rate, memory), crash and bug reports;
• an app instance ID created by Google Analytics for Firebase, only if you accept analytics;
• device identifiers used for attribution, only if you accept analytics: the advertising ID or App Set ID on Android, and the identifier for vendors (IDFV) on iOS. We do not ask for permission to track you on iOS (App Tracking Transparency), so we do not access your iOS advertising identifier (IDFA);
• install information: the store, campaign or link that led to the installation;
• your IP address, which is received by our servers, by Google Analytics for Firebase and by our attribution partner when Data is sent, and may be used to derive an approximate location (country);
• your messages and feedback when you contact us, and our answers;
• your consent choices, and the date, time and version of the terms of service you accepted.

We do not collect your contacts, precise location, photos or payment information. We only collect your email address if the Game requires an account or if you write to us.

2.3 How Data is collected

Data is collected:

• from you, when you create an account, play, contact us or give us feedback;
• automatically by the Game while you play, and by the software development kits (SDKs) of our analytics and attribution partners embedded in the Game, only after you accept analytics;
• from Apple or Google, when you sign in with these services.

2.4 With whom we share Data

When you consent to the collection of Data for advertising and third party analytics purposes, we may share the data listed above with the following categories of recipients:

a) Analytics partners:

• Singular Labs, Inc. (attribution and analytics), which processes Data on our behalf: Singular's privacy policy.
• Google Ireland Limited, for Google Analytics for Firebase (analytics), which processes Data on our behalf: Google's privacy policy and Privacy and security in Firebase.

b) Storage / Servers

• Google Cloud Platform (hosting and storage of our analytics), which processes Data on our behalf: Google Cloud privacy notice.

Our service providers process Data only on our instructions and are bound by contract to protect it at a level at least equivalent to this policy.

We may also disclose Data if required by law or by a public authority, or to a buyer or successor in the event of a merger, acquisition, restructuring or sale of all or part of our assets.

Our Games are distributed through Google Play and the Apple App Store, which process your Data as independent controllers under their own privacy policies. When a Game offers in-app purchases, payments are processed by Apple or Google: we never receive your payment details.

We do not sell your Data and we do not share it for advertising.

2.5 Retention

Analytics Data is kept for a maximum of 25 months from its collection, then deleted or anonymised. The player ID and your consent choice are stored on your device and are deleted when you uninstall the Game.

When the Game has an account, your account Data is kept for the duration of your account, and the Data needed to deal with breaches of our terms of service for 6 months after its closing. Data relating to the exercise of your rights is kept for 5 years, as evidence.

2.6 Children

Our Games are not directed at children. We do not collect any Data on the basis of consent (analytics, attribution, promotional notifications) from players under the age of digital consent in their country (15 years old in France). If you believe we have collected Data from a child in breach of these rules, please contact us at support@opusmajor.io and we will delete it as quickly as possible.

2.7 Storage and international transfers

The analytics Data in our own systems is stored on Google Cloud Platform servers located in the European Union.

Our attribution partner Singular is based in the United States, and Google may process Data in the United States: when Data is transferred outside the European Economic Area, it is protected by appropriate safeguards, such as the Standard Contractual Clauses adopted by the European Commission or the recipient's participation in the EU-US Data Privacy Framework.

2.8 Security

We take appropriate technical and organisational measures to protect your Data: Data is sent over encrypted connections (HTTPS), access to Data is restricted to the people who need it, and our service providers are bound by contract to protect it.

When you visit our opusmajor.io Website, here are the information that we may collect and process:

• technical data needed to deliver the Website and keep it secure (for instance, IP address, access times, browser type and language), kept in the logs of our hosting provider;
• if you contact us or respond to messages and communications that we send to you, we may keep a record of that correspondence;
• your interactions with us on our social media channels.

We use these information to operate and secure the Website and to answer you. If you no longer wish to receive emails from us, you may opt-out at any time by emailing us at contact@opusmajor.io.

Our Website does not use analytics or advertising cookies.

Under data protection law, you have certain rights in connection with your personal Data and how we handle it. You can exercise these rights at any time by contacting us at contact@opusmajor.io:

• Right of access. You have the right to know what Data we hold about you and in some cases to have it communicated to you.
• Right to rectification. You have the right to ask us to rectify or complete Data you think is inaccurate or incomplete. When the Game has an account, you can also change some of your Data directly in the Game's Settings.
• Right to erasure. You have the right to ask us to erase your Data in certain circumstances.
• Right to restrict processing. In some cases, you may have the right to request a restriction of the processing of your Data, such as when you are disputing its accuracy.
• Right to data portability. When the processing is based on consent or on our contract with you, you may have the right to receive the Data you provided to us in a portable format, or to have it sent to another controller.
• Right to object. You have the right to object to the processing of your Data based on our legitimate interests, and to object at any time to receiving emails about our Games, by clicking the unsubscribe link included in each of them.
• Right to withdraw consent. You can withdraw your consent at any time in the Game's Settings.
• Right to give instructions about your Data after your death. You can define instructions on the retention, deletion and communication of your Data after your death.

When a Game has no account, it does not ask who you are, so we can only find your Data from your player ID: please include it in your request. You can find it, and copy it, in the Game's Settings. When a Game has an account, please write to us from the email address linked to it. We reserve the right to ask for reasonable evidence to verify that the Data relates to you. To have your Data deleted, follow the steps in "Delete your data" below.

To stop all future collection, turn off analytics in the Game's Settings, or uninstall the Game. On Android, you can also reset or delete your advertising ID in your device settings.

You are not required to pay any charge for exercising your rights. We will answer your request within one month.

5.1 Games without an account

To delete the Data we hold about you, send us your player ID.

How to request deletion

1. Open the Game, go to Settings and tap "PLAYER ID" to copy it.
2. Optionally, set "ANALYTICS: OFF" in the same screen, so that no new Data is collected.
3. Send an email to support@opusmajor.io with the subject "[Game name] - Delete my data" and paste your player ID.
4. We delete your Data within one month and confirm it by email.

What is deleted

• All the analytics Data linked to your player ID on our servers: gameplay data, device and technical data, IP address.
• The attribution Data our partner Singular holds for us about your device: we forward your request to Singular.
• The analytics Data Google Analytics for Firebase holds for us under your player ID: we ask Google to delete it.

What is kept

• Statistics that no longer contain your player ID or any other identifier (for example, the number of players who finished the tutorial), which are not personal Data.
• Copies in our cloud provider's recovery systems, erased automatically within 30 days of the deletion.
• Our email exchange about your request, kept for 1 year as proof that we handled it, then deleted.

Your progress, settings and player ID are stored only on your device: we cannot access them. Uninstalling the Game deletes them.
